How Much Is My Personal Injury Case Worth?

The value of your personal injury case depends on a variety of factors.

Some insurance companies, in cases where the liability is clear, relate the value of a case to the “special damages.” This is often an unrealistic evaluation since your major damages might be physical pain and suffering, loss of capacity to lead a normal life, and other factors which do not cause actual bills to be incurred by you.

In evaluating your case, there are many important factors involved, including:

  1. How certain are we that we can win for you and make the other side pay for the damages they have caused?

  2. How badly were you injured?

  3. How much insurance does the responsible person carry?

Naturally, a person who has received a serious and crippling injury immediately is entitled to recover more money than an individual who had received only minor injuries.

Typically the insurance adjuster makes his offer primarily based on the total of your medical bills (and she will question each of those). Of course that dollar amount only tells half the story. Issues like the following tell the rest of the story in litigation, usually in preparation for a mediation:

  1. How did this accident affect your quality of life?

  2. What activities did the pain prevent you from doing?

  3. What problems did the loss of your car or income cause?

  4. How was your family and significant others affected?

Also remember that the insurance companies will not disclose that information until a lawsuit is filed. Under New Mexico's Mandatory Financial Responsibility Act, the minimum coverage for New Mexico is $25,000.00 per person and $50,000.00 per accident. Your settlement or judgment is usually limited by the total insurance available. We will discuss using any available uninsured or underinsured motorist coverage that you carry if it appears that the Defendant is uninsured or underinsured.

The true value of your claim is always debatable. This is why you need an experienced personal injury lawyer to help you navigate through this confusing process.
